#oobitme Campaign - Terms

BY PARTICIPATING IN THE CAMPAIGN, YOU AGREE TO THESE RULES, WHICH ARE A CONTRACT, SO READ THEM CAREFULLY BEFORE PARTICIPATING. WITHOUT LIMITATION, THIS CONTRACT INCLUDES INDEMNITIES TO THE SPONSOR FROM YOU. THIS CAMPAIGN IS IN NO WAY SPONSORED, ENDORSED OR ADMINISTERED BY Instagram Inc., Telegram OR Twitter Inc. NO PURCHASE NECESSARY. A PURCHASE OR PAYMENT OF ANY KIND WILL NOT INCREASE YOUR CHANCES OF WINNING. PLEASE NOTE THAT AN OOBIT ACCOUNT IN GOOD STANDING IS REQUIRED TO RECEIVE A PRIZE. #oobitme Giveaway (the "Campaign") will be sponsored by Oobit Technologies UAB, Perktunkiemio g.13-91 12114 Vilnius, Lithuania (the: "Sponsor"). The Campaign is open only to legal residents of EU, Asia, Middle east. Australia and Canada, who are at least eighteen (18) years old at the time of entry and have an Oobit account in good standing (the: "Participant" or "Participants").

The Campaign is subject to all applicable state and local laws and regulations and is void where prohibited. Participation constitutes the Participant's full and unconditional agreement to these Terms. Sponsor's decisions are final and binding in all matters related to the Campaign. Winning a prize is contingent upon fulfilling all requirements set forth herein, including a review of Participants public social profile. If a Participant has engaged in conduct on its public social profile that could damage the reputation of or reflect unfavorably on Sponsor or any of the Released Parties, as determined by Sponsor in its sole discretion, such Participant will be disqualified.

Campaign Duration

Each campaign will continue for 7 days (the "Promotion Period"). Oobit reserves the right to stop or cancel the Campaign at any time on its sole discretion.

Participation Requirements

To participate, you will need to have a Twitter and/or Instagram account (each a "Social Account"). Please be aware that third-party websites and other third parties such as Twitter and/or Telegram and/or Instagram have their own Terms of Use and privacy and data collection policies and practices. Oobit is not responsible for the Terms of User nor the privacy practices of such sites and will not be responsible for any actions or policies of such third parties. We encourage our users to be aware when they create each Social Account or use it and to read the Terms of Use and the privacy statements of each and every website that you visit.
Please note that sharing to Instagram Stories requires a mobile device. If entering via a mobile device and using your wireless carrier's network, standard data charges from your wireless carrier may apply.

Campaign participation instructions

First locate Sponsor's Campaign Post/ Tweet that is posted in Instagram and/or Twitter (the: "Post") then take the following actions during the Promotion Period:

  • -Follow Oobit on Twitter and/or Instagram;
  • -Join the Oobit official Telegram channel;
  • -Like the Post;
  • -Add a comment to the Post and elaborate on a personal experience with cryptocurrencies;
  • -Attaching a screenshot of the QR code from your personal account in Oobit App is not mandatory but will grant extra points as part of the overall scoring calculation;
  • -The most authentic comment that will receive the highest number of points according to the score table below, will win a prize.
  • -Score table:
    • Like equals 1 point
    • Retweet / share equals 3 points
    • Share QR code in the comment - 5 points

Please Note: If you choose to include additional content, it must be your original work and must not be indecent, obscene, hateful, tortious, defamatory, libelous, contain material that violates or infringes another's rights, disparage Sponsor or any other person or party, or contain material that is unlawful in any way; The Sponsor, in its sole discretion, may disqualify any comment that it finds unlawful, or in violation of these Terms, or any Participant whose public social profile demonstrates conduct that could damage the reputation of or reflect unfavorably on Sponsor.

Entry Limitations: Use of any automated system to participate is prohibited and will result in disqualification. In the event of a dispute as to any registration, the authorized account holder of the Twitter/Instagram account used to register will be deemed to be the Participant. The "authorized account holder" is the natural person assigned an email address by an Internet access provider, online service provider or other organization responsible for assigning email addresses used to create the Twitter/Instagram account. Each potential winner may be required to show proof of being the authorized account holder. Released Parties (as defined below) are not responsible for lost, late, unreceived, damaged, incomplete, invalid, unintelligible, garbled, delayed or misdirected Submissions or failure to receive Submissions due to limitation of third-party social network platforms all of which will be void.

Sponsor's Use of Social Post Content: Retweeting/Commenting constitutes Participant's consent to give Sponsor a royalty-free, irrevocable, perpetual, non-exclusive license to use, reproduce, modify, publish, create derivative works from, and display such submissions in whole or in part, on a worldwide basis, and to incorporate it into other works, in any form, media or technology now known or later developed, including for promotional or marketing purposes. If requested, Participant will sign any documentation that may be required for Sponsor or its designees to make use of the non-exclusive rights Participant is granting to use the Submission.

Prize Drawing: Sponsor's decisions as to the administration and operation of the Campaign and the selection of the potential winners are final and binding in all matters related to the Campaign.

Taxes: Prize recipients are responsible for all taxes and fees associated with prize receipt and/or use.

Release: By receipt of any prize, winners agree to release and hold harmless Sponsor, Twitter, Inc., Instagram, Inc., and their respective subsidiaries, affiliates, suppliers, distributors, advertising/promotion agencies, and prize suppliers, and each of their respective parent companies and each such company's officers, directors, employees and agents (collectively, the "Released Parties") from and against any claim or cause of action, including, but not limited to, personal injury, death, or damage to or loss of property, arising out of participation in the Campaign or receipt or use or misuse of any prize.

Publicity: Except where prohibited, participation in the Campaign constitutes each Participant's consent to Sponsor's and its agents' use of Participant's name, prize information, likeness, entry, photograph (including, without limitation, Participant 's Twitter/Instagram profile photo), voice, opinions and/or hometown and state for promotional purposes in any media, worldwide, without further payment or consideration.

General Conditions: Sponsor reserves the right to cancel, suspend and/or modify the Campaign, if any fraud, technical failures, human error, or any other factor impairs the integrity or proper functioning of the Campaign, or any event or cause beyond Sponsor's control (e.g. events such as natural calamities, national emergencies, wide spread illnesses, declarations of war, acts of God, acts of terrorism) interferes with any aspect of the Campaign, including but not limited to fulfillment of the prize(s), as determined by Sponsor in its sole discretion. Sponsor reserves the right, in its sole discretion, to disqualify any individual it finds to be tampering with the entry process or the operation of the Campaign or to be acting in violation of the Terms of this or any other promotion or in an unsportsmanlike or disruptive manner. Any attempt by any person to deliberately undermine the legitimate operation of the Campaign may be a violation of criminal and civil law, and, should such an attempt be made, Sponsor reserves the right to seek damages from any such person to the fullest extent permitted by law. Sponsor's failure to enforce any term of these Terms shall not constitute a waiver of that provision.

Limitations of Liability: The Released Parties are not responsible for: (1) any incorrect or inaccurate information, whether caused by Participants, printing errors or by any of the equipment or programming associated with or utilized in the Campaign; (2) technical failures of any kind, including, but not limited to malfunctions, interruptions, or disconnections in phone lines or network hardware or software; (3) unauthorized human intervention in any part of the entry process or the Campaign; (4) technical or human error which may occur in the administration of the Campaign or the processing of entries; (5) late, lost, undeliverable, damaged or stolen mail; or (6) any injury or damage to persons or property which may be caused, directly or indirectly, in whole or in part, from Participant's participation in the Campaign or receipt or use or misuse of any prize.

Indemnification

You agree to defend, indemnify and hold harmless Oobit, its affiliates, licensors and service providers, and its and their respective officers, directors, employees, contractors, agents, licensors, suppliers, successors and assigns from and against any claims, liabilities, damages, judgments, awards, losses, costs, expenses or fees (including reasonable attorneys' fees) arising out of or relating to your violation of these Terms of Use other than as expressly authorized in these Terms of Use or your use of any information obtained from any of the Website.

Disputes: Except where prohibited, Participant agrees that: (1) any and all disputes, claims and causes of action arising out of or connected with this Campaign or any prize awarded shall be governed and interpreted in accordance with the laws of the Republic of Lithuania. Any dispute between the Parties shall primarily be resolved through mutual negotiations. If agreement cannot be reached in these negotiations, the Parties agree that any dispute, controversy or claim arising out of or relating to this Agreement, its breach, termination or validity shall be finally settled by the Lithuanian courts.; (2) any and all claims, judgments and awards shall be limited to actual out-of-pocket costs incurred, including costs associated with entering this Campaign, but in no event attorneys' fees; and (3) under no circumstances will Participant be permitted to obtain awards for, and Participant hereby waives all rights to claim, indirect, punitive, incidental and consequential damages and any other damages, other than for actual out-of-pocket expenses, and any and all rights to have damages multiplied or otherwise increased.

All issues and questions concerning the construction, validity, interpretation and enforceability of these Terms, or the rights and obligations of the Participant and Sponsor in connection with the Campaign, shall be governed by, and construed in accordance with, the laws of the Republic of Lithuania. Any dispute between the Parties shall primarily be resolved through mutual negotiations. If agreement cannot be reached in these negotiations, the Parties agree that any dispute, controversy or claim arising out of or relating to this Agreement, its breach, termination or validity shall be finally settled by the Lithuanian courts.
