Electronic Signatures: How Consent and Delivery Work

Overview

Electronic signatures are a method of indicating agreement to a document or transaction using electronic processes rather than handwritten ink. Consent in electronic signing is typically established by demonstrating the signer’s intent to agree and linking that intent to an identifiable actor. Practical delivery requirements are often satisfied by (1) presenting the terms in a readable format before signature, (2) ensuring the signer can retain or reproduce the record (for example, via download link, email copy, or in-app document vault), and (3) preserving integrity so the signed content cannot be altered without detection. Many e-signature platforms apply tamper-evident sealing (hashing and signature verification) and maintain immutable logs so that the delivered copy can be verified as the same record that was accepted.

Evidence and enforceability in practice

Whether an electronic signature is legally effective generally depends on the applicable jurisdiction and the transaction type, but enforceability tends to rest on the same practical pillars: clear intent to sign, reliable attribution to a signer, and an unaltered record of what was signed and delivered. For operational reliability, organizations often standardize retention periods, revocation and correction procedures, and methods for producing an audit package that includes the signed document, certificate of completion, and event history. In cross-border settings, additional attention is commonly given to local consumer disclosure rules, language requirements, and how electronic records are provided to the user.
