Oobit has introduced a rewards programme. This means we will award you points, which you can exchange for USDC, when you use Tap to Pay or engage in specified activities on our app. The number of points you receive will increase based on the number of qualifying payments you make. The terms in this annex supplement our Terms of Use and explain the eligibility requirements and how rewards are accrued in this rewards programme.
By participating in the rewards programme, you acknowledge and understand that you must comply with the terms set out in this annex.
1.1 Under the rewards programme we will award points to users for completing specified activities on the app such as using Tap to Pay. There are no additional fees to participate in the rewards programme, but Oobit’s standard transaction fees may apply.
1.2 If you meet the eligibility requirements and engage with the Oobit app by using the Tap to Pay service or completing other activities listed on the rewards page in the app, you will automatically start to collect points.
1.3 You can track your collection of points, check your current level and exchange your points for USDC on the rewards page in the app.
1.4 Once you have started collecting points, you can convert the points to USDC through the app. The USDC will then appear in your account balance on the app for you to use. The exchange rate for this conversion will be set by us and will be adjusted by us on a daily basis or otherwise in our discretion from time to time. There is no threshold on the minimum number of points that must be collected before these can be exchanged for USDC, although Oobit reserves the right to introduce this threshold at any time and without prior notice.
1.5 All rewards earned through the Rewards Program will be restricted for use exclusively on Tap to Pay payments, within the app. These rewards cannot be withdrawn, transferred, or used outside the Oobit platform.
2.1 Tap to Pay Rewards are structured into levels, with specific eligibility requirements and rewards corresponding to each level as set out in the table below.
2.2 All new users on the Oobit app will begin at level 1 of the rewards programme by default. If you are located in a country where the Tap to Pay service is not available, you will remain at level 1. If you are a level 1 user, you will be eligible to receive level 1 rewards, such as collecting 1,000 points for each Qualifying Payment you make (the meaning of a Qualifying Payment is explained in the next paragraph).
2.3 To progress to level 2, you must make at least five Qualifying Payments within a 30-day period. A Qualifying Payment means a payment through the app using the Tap to Pay service of a value equivalent to at least EUR 1 at the time of payment. To receive rewards corresponding to levels 2 to 5, you must have made the required number of Qualifying Payments corresponding to that level in the past 30 days.
2.4 If you have made five Qualifying Payments within the past 30 days, you will automatically receive level 2 rewards for the next 30 days (starting from the date of the final Qualifying Payment). You can move up levels at any time by making more Qualifying Payments. If at any time you have not made at least five Qualifying Payments within the past 30 days, you will immediately drop back to level 1.
2.5 For example, if you made five Qualifying Payments on 15 March, you would move up to level 2 on 15 March and would receive level 2 rewards until 13 April. If on 20 March you made five further Qualifying Payments, you would automatically move up to level 3 on 20 March and would receive level 3 rewards until 13 April. However, if you didn’t make any further Qualifying Payments before 14 April, you would stop receiving level 3 rewards and would move down to level 2 on 14 April (due to you only having made five Qualifying Payments in the past 30 days, rather than the ten Qualifying Payments required to remain in level 3). If you then didn’t make any further Qualifying Payments before 19 April, you would stop receiving level 2 rewards and would move down to level 1 on 19 April.
2.6 Payments will not be considered Qualifying Payments where:
(A) you do not hold sufficient cryptoassets in your account to pay for the transaction.
(B) the merchant that you are making the payment to does not receive the payment; or
(C) you request a refund from the merchant, or your payment is reversed.
2.7 If we send you rewards and then later discover the payment to which the rewards relate was not a Qualifying Payment, we may recoup all or part of the rewards sent in relation to that payment.
3.1 There are other ways for users engage with the app to collect points in addition to the Tap to Pay Rewards set out above. We have described these in this section, but Oobit may add, remove, or change these rewards in its discretion at any time.
3.2 You can collect points for referring friends to use the app or completing social media engagement challenges such as following Oobit on X and TikTok or subscribing to the Oobit YouTube channel. You do not need to use the Tap to Pay service to participate in these challenges, unless otherwise stated on the rewards page in the app.
3.3 From time to time, we may offer an additional reward if you use a specific type of cryptoasset to make a Qualifying Payment, where we will add cryptoassets to your account on the app (in addition to any points you collect in relation to that payment). The amount of the cryptoasset that we add to your account will be calculated as a percentage of the value of the Qualifying Payment that you made in the specified typed of cryptoasset.
3.4 Several of our rewards are reserved for users that satisfy the criteria for certain levels in the Tap to Pay Rewards. You will automatically have access to these rewards from the rewards page on the app if you are eligible. For instance, if you are in level 3 or above, you can claim random daily rewards for checking the rewards page. If you are in level 5, you will receive a monthly airdrop of a random amount of USDC from Oobit.
4.1 To be eligible to participate in the rewards programme, you must:
(A) be an existing onboarded and approved user of the Oobit app and have passed all of our onboarding, registration and Know Your Customer checks;
(B) remain at all times in compliance with our Terms of Use;
(C) have an Oobit account that is not suspended, restricted, terminated or otherwise;
(D) (in relation to Tap to Pay Rewards) make Qualifying Payments and hold sufficient cryptoassets in your account to fund those Qualifying Payments; and
(E) read, understand, and agree to the terms in this annex and the rewards programme FAQs as may be updated from time to time.
4.2 Your eligibility to receive rewards is at all times subject to your continuing compliance with the terms in this annex and the eligibility criteria set out above.
4.3 You represent and warrant that you meet the eligibility criteria and that your participation in the rewards programme will not violate any applicable laws in your respective jurisdiction, or the terms in this annex or the rights of any third party.
4.4 Notwithstanding your meeting the eligibility criteria above, we reserve the right to refuse your request to participate and/or to suspend your participation in the rewards programme at any time in our sole discretion, with or without notice to you, including if we suspect or find that you have acted fraudulently, dishonestly, disruptively, in bad faith, or displayed behaviour that may bring us into disgrace or disrepute. Further, we reserve the right to change the eligibility criteria at any time with or without notice to you.
5.1 In addition to other prohibited activities set out in the Terms of Use, by participating in the rewards programme, you agree that you will not do any of the following:
(A) violate or breach the terms in this annex; or
(B) engage in any form of data mining, indexing, scraping, surveying, or otherwise, or use any robot, spider, or scraper with respect to the app, the rewards programme or any other related product, programme or system.
6.1 The rewards programme is organised and provided by Oobit Technologies UAB a company whose registered address is at Republic of Lithuania at Gedimino pr. 9, Vilnius 01105, Lithuania (306074900).
6.2 Oobit will not be liable for any losses that are unforeseeable, avoidable or caused as a result of any events outside its control, whether directly or indirectly suffered.
6.3 In addition to the other rights set out in this annex and those that may be available to us, you agree that you will indemnify and hold harmless Oobit and its affiliates from any legal or monetary consequences that arise from any unauthorised participation by you in the rewards programme.
6.4 Points, USDC and other rewards in this rewards programme are awarded by Oobit in our sole discretion and as a gratuity. If for any reason a reward or part of a reward is unavailable, we reserve the right to modify the rewards programme in our sole discretion and award a substitute reward or portion of a reward of comparable or greater value. We have no responsibility or obligations to users that are unable to, or do not, for any reason claim or use a reward. The rewards are provided on an “as is” basis.
6.5 The value of the reward may be taxable to you as income. All tax liability and any other costs and expenses associated with claiming or using the rewards not specifically provided for in this annex are solely your responsibility.
6.6 We may decide to vary the terms of the rewards programme or terminate the rewards programme for any reason and we do not have to provide advance notice. Changes will become effective upon posting unless stated otherwise. We reserve the right to cancel, suspend, modify or replace the rewards programme and/or the rewards in our sole discretion at any time without prior notice to you, including for any regulatory or legal reasons. By using our services after changes, you agree to follow the updated terms in this annex. If you disagree, you can close your account.
6.7 If you close your account or your account becomes suspended or restricted before you receive or claim any outstanding accrued rewards, you will lose your entitlement to those rewards.
